Booking Terms, Player Safety Rules & Conditions

These terms apply to the person making the booking and all players and guests included in the booking, including participants attending as part of a group, event, party or competition.

By completing a booking, the person making the booking confirms that they:

  • have read and understood these terms, including the Important Legal Warning;
  • are authorised to make the booking for the group;
  • will make these terms and safety rules available to all participants in their booking before they play;
  • will ensure all participants are made aware of the important safety rules and risks associated with indoor golf; and
  • accept responsibility for ensuring members of their group comply with staff instructions and venue safety rules while at The Golf Room.

Each participant is responsible for complying with these terms and safety rules when using The Golf Room’s facilities.

1. Conduct & Safe Play

For everyone’s safety:

  • Follow staff instructions at all times, including instructions about bay allocation, equipment and booking times.
  • Only one person may be in the hitting/swing area at a time.
  • Swing only when it is your turn and all other players and guests are safely behind and clear of the hitting area.
  • Do not swing clubs outside the designated hitting area.
  • Do not enter the hitting area or retrieve balls while another player is preparing to hit.
  • No running, horseplay or deliberately unsafe behaviour.
  • Appropriate footwear must be worn. Bare feet are not permitted.
  • Do not deliberately hit balls anywhere other than toward the designated simulator screen.
  • Stop playing and notify staff immediately if you notice damaged equipment, a trip hazard or another safety concern.

Abusive, threatening, destructive or unsafe behaviour toward staff or other guests may result in removal from the venue.

2. Alcohol

Alcohol is served responsibly and in accordance with Victorian liquor licensing requirements.

Staff may refuse further alcohol service and/or require a person to stop playing if they appear intoxicated or if continuing to play would create a safety risk.

The Golf Room may suspend or terminate play where staff reasonably consider a person’s conduct, intoxication or use of equipment to present a safety risk.

A refund will not be provided where play is terminated because of a player’s unsafe, abusive or prohibited conduct.

3. Health & Participation

Indoor golf involves physical activity, including repeatedly swinging a golf club.

Each participant is responsible for deciding whether they are physically able to participate.

Anyone with an injury, medical condition, pregnancy or other circumstance that may be affected by physical activity should consider seeking appropriate medical advice before participating.

4. Risks of Participation

Golf and golf simulation involve inherent risks. These can include:

  • being struck by a golf club or ball;
  • injury caused by another player’s swing;
  • muscle strains and other physical injuries;
  • slips, trips and falls; and
  • injury resulting from incorrect or unsafe use of equipment.

Participants acknowledge that these risks exist and are required to follow The Golf Room’s safety rules and staff instructions.

5. Damage to Equipment & Property

Players must use simulators, screens, golf clubs and other equipment only for their intended purpose and in accordance with staff instructions.

A participant may be responsible for the reasonable cost of repairing or replacing equipment or property damaged as a result of their deliberate, reckless or negligent misuse, or failure to follow staff instructions.

Participants are not responsible for normal wear and tear or equipment failure occurring during normal and appropriate use.

6. Personal Belongings

Please keep personal belongings with you.

To the extent permitted by law, The Golf Room is not responsible for personal property that is lost, stolen or damaged while on the premises.

7. Children & Young People

Players under 18 must be appropriately supervised by a responsible adult.

Parents, guardians and supervising adults are responsible for ensuring children in their care follow staff instructions and The Golf Room’s safety rules.

Where the person making a group booking is not the parent or legal guardian of a participating child, they are responsible for ensuring the child’s parent or guardian is made aware of these terms and the nature of the activity before the child participates.

8. Governing Law

These terms are governed by the laws of Victoria, Australia.

9. Limitation of Liability & Important Legal Warning

To the extent permitted by law, applicable statutory guarantees are excluded, restricted or modified in relation to liability for death or personal injury arising from recreational services provided by The Golf Room.

This limitation does not apply where death or injury is caused by gross negligence on the part of The Golf Room and does not exclude, restrict or modify any right or remedy that cannot lawfully be excluded, restricted or modified.

IMPORTANT LEGAL WARNING

WARNING: If you participate in these activities your rights to sue the supplier under the Australian Consumer Law and Fair Trading Act 2012 if you are killed or injured because the activities were not supplied with due care and skill or were not reasonably fit for their purpose, are excluded, restricted or modified in the way set out in this notice.

NOTE: The change to your rights, as set out in this notice, does not apply if your death or injury is due to gross negligence on the supplier’s part.

Gross negligence, in relation to an act or omission, means doing the act or omitting to do an act with reckless disregard, with or without consciousness, for the consequences of the act or omission.

See regulation 5 of the Australian Consumer Law and Fair Trading Regulations 2022 and section 22(3)(b) of the Australian Consumer Law and Fair Trading Act 2012.

 

10. Privacy

When you make a booking, we collect and use personal information such as your name, email address and phone number to manage your booking and provide our services. Your information is handled in accordance with our Privacy Policy.
